1. Definitions
- Hunterz: the software platform (web app + mobile app) provided by Elemos bv, Belgium.
- Customer / Hunting Group: the legal or natural person subscribing to a plan.
- User: any person with access to the platform via a customer account.
- Subscription: the annual right to use the service, including chosen modules.
2. Acceptance of Terms
By starting a subscription or using the platform, the customer fully accepts these terms.
Minors may only use the platform under the supervision of a legal representative.
3. Offering and Services
Hunterz offers a digital management platform for hunting groups, with optional modules
(e.g. map editor). Available features are described on the website and may evolve.
Changes are communicated at least 30 days in advance.
4. Subscription and Payment
- Subscriptions apply for one annual season (12 months) and are processed via Mollie B.V.
- Pricing depends on the chosen tier (based on member count) and selected modules, as shown at checkout.
- A free 14-day trial applies at the start. The first payment is made automatically thereafter.
- Discount codes (coupons) can be entered at checkout. They are valid once per hunting group.
- Prices are in euros (€), including Belgian VAT unless stated otherwise.
- In case of late payment, Hunterz reserves the right to restrict access until full payment.
5. Cancellation and Refund
- The customer may cancel the subscription at any time via the hunting group settings.
- After cancellation, the service remains available until the end of the paid period.
- No refunds are provided for already paid annual periods, except in the case of a proven error by Hunterz.
- Hunterz may terminate the subscription in case of serious breach of these terms, after written notice.
6. Platform Use
The customer agrees to use the platform only for lawful hunting-related activities and in
accordance with applicable hunting laws. The following are prohibited:
- processing third-party personal data without their consent;
- using the service for spam, phishing or other unsolicited communications;
- circumventing the platform's security measures;
- reselling or sub-licensing the platform to third parties.
7. Data and Ownership
All data entered by the customer (hunt days, members, harvests, etc.) remains the property of the customer.
Hunterz processes this data solely as a processor on behalf of the customer.
Upon cancellation, the customer may request a data export within 30 days of cancellation.
8. Availability and Liability
- Hunterz targets 99.5% monthly availability, excluding planned maintenance windows.
- Hunterz is not liable for indirect damages, consequential losses or loss of profit.
- Hunterz's total liability is limited to the amount paid by the customer in the 12 months prior to the incident.
9. Intellectual Property
All rights to the Hunterz platform, software, brand name and associated content are owned by Elemos bv.
The customer receives only a non-exclusive, non-transferable licence to use the service for the duration of the subscription.
10. Changes to Terms
Hunterz may update these terms. The customer is notified by email at least 30 days in advance.
Continued use of the service after the effective date constitutes acceptance of the updated terms.
11. Governing Law and Jurisdiction
These terms are governed by Belgian law. In case of disputes, the courts of
Kortrijk have exclusive jurisdiction.
